Executors

The person(s) who will administer your estate. You can appoint up to two primary executors and a substitute in case they cannot act.

An executor must be 18 or over and of sound mind. It's wise to appoint at least two primary executors or one primary plus a substitute.

Specific Gifts

Particular items, property, or sums of money you want to leave to named individuals or charities.

A specific gift is a named item (jewellery, a car, a painting, a property) left to a named person. A pecuniary (cash) gift is a fixed sum. Both go out before the residue is divided.

Residuary Estate

Everything left after debts, expenses, and specific gifts are paid. This is usually the largest part of your estate.

The residue is what remains after everything else has been distributed. Most people leave it all to a spouse/partner first, then to children equally — but you can split it however you choose.
Be as specific as you can — name people and state shares (e.g. 50%/50%, equally, two-thirds/one-third).
A survivorship period prevents assets passing under two Wills in quick succession if both spouses die close together.
Good practice if all your beneficiaries could conceivably predecease you.

Property & Assets Overview

Brief details to help Claude draft the correct provisions — no precise values needed.

Joint tenants: your share passes automatically to the survivor regardless of your Will. Tenants in common: your share is controlled by your Will.
Pensions: most pension funds do not form part of your estate and pass by nomination form — not via your Will. Make sure your pension provider's expression of wishes is up to date.

Trusts (optional)

Simple trust provisions that are commonly included in Wills. Complex arrangements (e.g. Property Protection Trusts, Asset Protection Trusts) need a full review — contact us.

A life interest trust keeps the remainder of the estate for your chosen beneficiaries (e.g. your children) while still providing for a surviving spouse.
